NON-COMMERCIAL BCS LICENSE
License Agreement

1. Grant of License

The Copyright holder hereby grants a non exclusive, non transferable license to use the software for private test purposes for a limited period of one year. The grant of license does not include any non-private and/or commercial use of the software, whether direct or indirect. If such non-private and/or commercial use is intended, a separate license for commercial purposes has to be obtained.

This license to use the software for private test purposes does include the necessary copying of the software to run the software. This license does not allow distribution of the software to third parties whether online or offline.

Except for the aforementioned rights, no other rights are hereby granted to use the software. The user of the software is in particular not allowed to alter, further develop or otherwise change the software without the prior consent of the copyright holder except as provided by the applicable local mandatory laws.

2. Disclaimer of Warranty/Liability

THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDER "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES ARE EXCLUDED.

ANY LIABILITY OF THE COPYRIGHT HOLDER FOR NEGLIGENCE (WHETHER GROSS OR ORDINARY NEGLIGENCE) IS HEREBY EXPLICITLY EXCLUDED.

IN NO EVENT SHALL THE COPYRIGHT HOLDER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY WHETHER IN CONTRACT, STRICT LIABILITY OR TORT ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF SUCH DAMAGE. THE AFOREMENTIONED LIMITATION OF LIABILITY DOES NOT APPLY IF THE DAMAGES WERE CAUSED INTENTIONALLY BY THE COPYRIGHT HOLDER.

3. Applicable Law

This license agreement and all claims arising out of or in connection to it shall be governed by, construed and interpreted in accordance with the laws of the Federal Republic of Germany. The UN Sales Convention (CISG) is explicitly excluded. The courts of Hanover shall have exclusive jurisdiction.
